Terms and Conditions
1. Scope
1. These terms and conditions apply to all offers, agreements, and services provided by Klip. Any terms and conditions imposed by the buyer shall not be applicable.
2. In case of any conflict between an agreement and these terms and conditions, the agreement shall prevail.
2. Contracting Party, Contract Conclusion, Subject Matter
1. The purchase contract is made with Klip. By placing products in the online shop, we offer to enter into a contract for these items. You can add products to your cart without obligation and amend your details before submitting your order. The contract is concluded when the order button is clicked, and confirmation is received. It is the customer's responsibility to ensure the accuracy of the provided email address to receive communications without hindrance, such as from SPAM filters.
2. The contract pertains to the production and delivery of wall shelving solutions. Detailed product specifications are available in the item description and supplementary information on our website.
3. Contract Language, Contract Text Storage
English is the language for contract conclusion. We retain the contract text and send you order data and our terms and conditions via email. For security reasons, the contract text is not accessible online.
4. Delivery Terms, Delivery Time
1. Shipping costs are added to product prices unless otherwise stated. Production and delivery commence upon receipt of payment or order release. Standard delivery time is 6-8 weeks, subject to potential delays from logistics. For orders with varying delivery times, the total time is based on the longest duration. Special requests may extend delivery by 2 to 4 weeks. Holiday periods may also affect delivery times.
2. Delivery is exclusively via shipping; self-collection or delivery to parcel stations is not possible. Small items are couriered, while large items are delivered by freight. For freight deliveries, a delivery date will be arranged. Two delivery attempts are included; additional attempts incur a charge of EUR 40.00 each.
5. Payment
Unless otherwise specified, payment is due immediately upon contract conclusion.
iDeal: Payment is processed via iDeal's online platform.
Credit Card: Payment is automatically processed upon order placement after cardholder verification.
PayPal: Payment is securely processed through PayPal’s platform, allowing you to use your PayPal balance, linked bank account, or credit card for a quick and convenient transaction.
6. Transportation and Delivery Damage
1. Unless agreed otherwise, Klip arranges carriage and assumes risk for loss or damage. If professional carriers are involved, Klip must ensure adequate insurance.
2. Any damage upon delivery must be noted on the delivery receipt. Customers must inform Klip within two working days of delivery; failure to do so deems the goods received undamaged. If inspection at delivery is not possible, it must be noted on the receipt.
7. Liability
1. Klip is not liable for direct or indirect damages unless due to malicious intent or gross negligence.
2. Klip's liability is limited to the transaction value.
3. If no exoneration grounds apply, liability is limited to the coverage provided by Klip's liability insurance.
8. Exclusion of Right of Withdrawal / Contract Termination
Custom-made goods exclude the right of withdrawal due to individual specifications.
9. Warranty
1. Klip guarantees goods for normal use for twelve months after delivery.
2. Klip will rectify faults within a reasonable time frame.
3. Warranty does not cover wear and tear, misuse, lack of maintenance, or unauthorized alterations.
10. Complaints
1. Consumers must promptly and clearly notify Klip of any contract shortcomings.
2. Klip will respond to complaints within 14 days, or notify of extended processing time.
3. Consumers must allow Klip at least 4 weeks to resolve complaints jointly before escalation.
11. Applicable Law and Jurisdiction
All agreements are governed by Dutch law, and the District Court of The Hague has exclusive jurisdiction for complaints.
